Terms:

Article 1: Agreement to Terms By accessing or using our services, you agree to these terms and conditions, and any additional terms and conditions that may apply to specific services.

Article 2: Intellectual Property All content on our website or provided as part of our services, including but not limited to text, graphics, logos, images, and software, is the property of our business or its licensors and is protected by intellectual property laws.

Article 3: Limitation of Liability Our business is not liable for any damages, including but not limited to direct, indirect, incidental, consequential, or punitive damages arising from your use of our services.

Article 4: Lien Waiver If the customer fails to pay for our products or services in full, our company reserves the right to place a lien on the customer's property as permitted by law. The customer acknowledges and agrees that any such lien will be valid and enforceable, and that they will be responsible for any and all costs associated with the enforcement of the lien.

Article 5: Termination We reserve the right to terminate your access to our services at any time, with or without cause or notice.

Article 6: Warranty Peak Climate Heating and Air Conditioning LLC provides a one year parts and labor warranty on any new equipment replacements or installs provided by us. This warranty covers any defects in materials or workmanship that may arise within one year from the date of service. If any issues arise during the warranty period, Peak Climate Heating and Air Conditioning LLC will make any necessary repairs or replacements at no additional cost to the Owner. This warranty is valid only for the original Owner and is non-transferable. This warranty does not cover any damage resulting from neglect, misuse, or normal wear and tear. Peak Climate Heating and Air Conditioning LLC reserves the right to void this warranty if any unauthorized repairs or modifications have been made to the serviced equipment.

Article 7: Governing Law and Jurisdiction These terms and conditions are governed by the Construction Industry Arbitration Rules of the American Arbitration Association, and any disputes will be resolved in the courts of Boone County, MO.

Article 8: Modifications We may modify these terms and conditions at any time, and your continued use of our services after any modifications indicates your acceptance of the modified terms and conditions.

Article 9: Work Not Under Scope If the customer requests any additional work or changes the work that isn’t specified in the original scope of the project, Peak Climate Heating and Air Conditioning LLC will have the option to perform the work during regular business hours at a rate of $98 per hour, plus a management fee on any additional costs incurred, including but not limited to subcontractors, supplies, and rentals. Any such additional work will be considered a modification to this contract and will be subject to the terms and conditions set forth herein.

Article 10: Indemnification You agree to indemnify and hold harmless our business and its affiliates, officers, directors, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of our services or your breach of these terms and conditions.

Article 11: No Waiver Our failure to enforce any provision of these terms and conditions does not constitute a waiver of that provision.

Article 12: Entire Agreement These terms and conditions constitute the entire agreement between you and our business, and supersede all prior agreements or understandings, whether written or oral.
